Although renting out a property can be a good source of extra income, if legal advice is not first sought disagreements between landlords and tenants can arise. The result can be very costly to the Landlord in both time and money.
A written Tenancy Agreement sets out the rights and responsibilities of both landlord and tenant and therefore helps prevent disputes arising as each party knows where he or she stands.
Your Solicitor will discuss with you the type and length of tenancy required and any restrictions you wish to place on your tenant(s). The amount of rent, and what will be included in the rent, will need to be considered, along with deposit, service charges and maintenance and rights of access.
Once your Solicitor has all the required information, a Tenancy Agreement will be drawn up and explained to you, as will any related legal issues. Advice will include what type of references you should ask for when considering a tenant, and how to end the Tenancy Agreement.
Should a dispute arise between you and your tenant, your Solicitor can advise you as to your legal position and help you to settle the matter. If it becomes necessary, your Solicitor can negotiate with your tenant, amend the Tenancy Agreement, commence / defend legal proceedings, attend court hearings, etc.
Should you wish to reclaim possession of your property your Solicitor will advise you as to the serving of Notice on your tenant(s) and draw up the necessary document(s). Occasionally tenants fail to leave when the notice expires and it becomes necessary to commence court proceedings. Your solicitor can guide you through this process, draw up the required documents and represent you at any court hearings.
