The Licensing Act 2003 brought an entirely new concept to the law of liquor (and restaurant hot food and entertainment) licensing. The requirement of separate licences for the premises where the licensable activity takes place, and a person or persons permitted to operate within those premises was introduced. (“Personal Licences” and “Premises Licences”). Applications for both licences are now made to the Local Authority rather than the Magistrates Court, and initial hearings if they take place at all are before a Local Authority Committee with appeal lying to the Magistrates Court.
